2. Acceptance of Terms

By accessing or using mamataist.me (the "Platform" or "Service"), you agree to be bound by these Terms of Service, all applicable laws and regulations in India, and agree that you are responsible for compliance with any local laws of West Bengal and India. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

3. Indian Legal Compliance & Safe Harbor

This Platform operates as an "Intermediary" under Section 2(1)(w) of the Information Technology Act, 2000 (IT Act) of India. We do not initiate transmissions, select the receiver of transmissions, or select or modify the information contained in any transmission.

Consequently, we claim exemption from liability for any user-generated content hosted on our Platform under Section 79 of the IT Act, provided we comply with the due diligence requirements under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules.

4. User Rules & Code of Conduct

In compliance with Rule 3(1)(b) of the IT Intermediary Guidelines, you agree that you shall not host, display, upload, modify, publish, transmit, store, update, or share any information that:

• Belongs to another person and to which you do not have any right;
• Is defamatory, obscene, pornographic, pedophilic, invasive of another’s privacy, insulting or harassing on the basis of gender, libelous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force;
• Is harmful to child;
• Infringes any patent, trademark, copyright, or other proprietary rights;
• Violates any law for the time being in force (including Indian Penal Code/Bharatiya Nyaya Sanhita, IT Act, and electoral guidelines issued by the Election Commission of India);
• Deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
• Impersonates another person;
• Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation;
• Contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource.

5. Accounts, Membership Cards & Mamataist ID

Your account, including your auto-generated Mamataist ID and printable Membership Card, is for personal, non-commercial use only. You represent that the profile picture and name used are yours or you have the legal right to use them. The platform reserves the right to suspend accounts or revoke membership cards that violate the code of conduct or present false identity details.

6. Point System, Leaderboard & Tasks

The Platform offers community tasks and awards points for participation. These points represent community engagement and status on the unofficial Leaderboard. They have no cash value, cannot be traded, bought, sold, or redeemed for currency or items, and do not constitute any contractual right or entitlement to real-world assets.

7. Limitation of Liability

In no event shall the Platform, its administrators, contributors, or creators be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on mamataist.me, even if notified orally or in writing of the possibility of such damage.

8. Indemnification

You agree to defend, indemnify, and hold harmless the Platform, its administrators, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right or applicable Indian law.

9. Governing Law & Jurisdiction

Any claim relating to the Platform shall be governed by the laws of the **Republic of India** and the state of **West Bengal**, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in **Kolkata, West Bengal, India**, and you hereby consent to the personal jurisdiction and venue of such courts.
